Welcome to Heartwise Animal Wellness, LLC. By accessing this website, booking an appointment, purchasing a service, or participating in a Heartwise Animal Wellness session, you agree to the following Terms & Conditions.

Key Points

  • Heartwise Animal Wellness provides remote animal communication and complementary energy wellness services. These services do not replace veterinary, emergency, behavioral, or other qualified professional care.

  • No specific result is promised. Clients remain responsible for decisions about their animals’ health, safety, treatment, and wellbeing.

  • Cancellation or rescheduling requires at least 24 hours’ notice. Late cancellations, rescheduled appointments, and no-shows are subject to the refund rules below.

  • By booking or participating in a session, you confirm that you are at least 18 years old, have authority to request services for the animal, and agree to these Terms & Conditions.

  • Consumer rights that cannot legally be waived or limited will continue to apply.

Please read these Terms & Conditions carefully before using the Heartwise Animal Wellness website, booking an appointment, purchasing a service, or participating in a Heartwise Animal Wellness session.

By accessing the website, booking an appointment, purchasing a service, or participating in a session, you agree to these Terms & Conditions.

1. About Heartwise Animal Wellness

Heartwise Animal Wellness, LLC (“Heartwise,” “we,” “us,” or “our”) is owned by Amanda Bate and provides remote animal communication and complementary energy wellness services for animals of all species.

Services may include:

  • Animal Emotional Balance sessions using intuitive animal communication and Emotion Code® techniques; and

  • Whole Animal Wellness sessions using intuitive animal communication and Body Code® techniques.

Heartwise services are designed to provide complementary support and another perspective regarding an animal’s emotional, behavioral, energetic, and whole-being wellness.

Sessions are conducted remotely. Before the scheduled consultation, Heartwise may intuitively connect with the animal and listen for information, impressions, emotions, sensations, images, words, thoughts, or messages. The live consultation may include discussion of those impressions and complementary energy wellness work. Clients may receive detailed written follow-up session notes.

Heartwise welcomes animals of all species, including dogs, cats, horses, birds, farm animals, small animals, and other companion or working animals.

Heartwise does not provide:

  • Veterinary medicine;

  • Veterinary diagnosis or treatment;

  • Prescription or medical advice;

  • Emergency animal care;

  • Professional animal training;

  • Licensed animal behavioral services; or

  • Any other service requiring a professional license or credential that Heartwise does not hold.

2. Complementary Wellness Disclaimer

Heartwise services are intended for complementary wellness purposes only.

Animal communication and energy wellness services are not intended to diagnose, treat, cure, or prevent any disease, injury, medical condition, or behavioral disorder.

Heartwise services are not a substitute for:

  • Veterinary examination, diagnosis, or treatment;

  • Prescription medication or medical care;

  • Emergency veterinary services;

  • Professional animal training;

  • Veterinary behavioral care;

  • Licensed mental or behavioral health services; or

  • Other licensed or appropriately credentialed animal-care services.

If your animal is experiencing pain, injury, illness, difficulty breathing, neurological symptoms, poisoning, trauma, sudden behavioral changes, or another urgent or potentially serious medical concern, contact a veterinarian or emergency veterinary facility immediately.

Do not delay necessary veterinary, behavioral, or emergency care while waiting for a Heartwise session or relying on information received from Heartwise.

3. Animal Communication

Animal communication is an intuitive practice.

Information received during an animal communication session may present as impressions, emotions, imagery, sensations, words, thoughts, or other intuitive experiences.

Information shared during a session represents intuitive interpretation. It is not independently verified fact, veterinary diagnosis, medical advice, or a professional behavioral assessment.

Clients are responsible for deciding how, if at all, to use information received during a session. Any information that appears to relate to an animal’s physical health should be discussed with a qualified veterinarian.

Heartwise does not represent that an animal is communicating in a manner that can be independently verified or scientifically measured, or that every question will receive a specific answer.

4. Energy Wellness Services

Emotion Code® and Body Code® techniques are offered as complementary energy wellness practices.

These services are not veterinary medicine and are not intended to diagnose or treat medical conditions.

Heartwise does not represent that energetic findings correspond to medically measurable conditions or that releasing, balancing, or addressing energetic patterns will produce a specific physical, emotional, or behavioral outcome.

Clients should continue to follow the advice and treatment plans provided by their veterinarian, veterinary behaviorist, trainer, or other qualified professional.

5. No Guarantee of Results

Every animal is unique. Heartwise does not guarantee any specific outcome from animal communication, Emotion Code®, Body Code®, or any other complementary wellness service.

Purchasing or participating in a service does not guarantee:

  • A change in behavior;

  • Improvement in a health or wellness concern;

  • Resolution of emotional concerns;

  • A specific message from an animal;

  • A particular response to energy wellness work;

  • A change in the animal’s relationship with a person or another animal; or

  • A specific timeline for any change.

Clients understand that Heartwise services are complementary and exploratory in nature.

6. Client Responsibility

By booking or participating in a service, you confirm that:

  • You are the owner of the animal, or an authorized agent of the owner;

  • You are at least 18 years old, or at least the age of majority in your jurisdiction;

  • Information you provide is accurate to the best of your knowledge;

  • You have authority to request services for the animal;

  • You remain responsible for all decisions regarding the animal’s health, care, safety, treatment, and wellbeing;

  • You will seek appropriate veterinary, behavioral, emergency, or other professional care when necessary;

  • You understand that intuitive and energetic information does not replace professional medical or behavioral judgment; and

  • You will provide a safe and appropriate environment for the animal during any remote session.

Sessions involving animals owned by minors must be booked and paid for by a parent or legal guardian.

Heartwise does not make decisions regarding medication, medical procedures, veterinary treatment, supplements, diet changes, emergency care, training, behavioral management, or the overall care of an animal on behalf of a client.

7. Remote Sessions

Heartwise services are provided remotely unless otherwise stated.

The animal does not need to be physically present during the client consultation. Clients are responsible for submitting requested intake information and a recent photograph of the animal before the scheduled appointment.

Because animal communication and preparation may begin before the consultation, late or incomplete intake information may require the appointment to be rescheduled. The refund and rescheduling provisions in these Terms will apply.

Clients are responsible for having access to the telephone, video-conferencing platform, email account, internet connection, and other technology needed to participate in the consultation.

8. Session Notes and Recommendations

Clients may receive written session notes following an appointment.

Session notes may include:

  • Intuitive observations;

  • Information received during animal communication;

  • Energy wellness observations;

  • Messages or impressions;

  • Suggested areas for observation; and

  • Recommendations to discuss with a veterinarian or other qualified professional.

Session notes are intended for the client’s personal use. They are not veterinary records, medical documentation, professional behavioral evaluations, or emergency-care instructions.

Session notes should not be provided to or relied upon by another person as a substitute for advice from a qualified veterinarian, behavioral professional, or other appropriately credentialed professional.

9. Scheduling, Cancellations, and Rescheduling

Heartwise requires at least 24 hours’ notice to cancel or reschedule an appointment.

Appointments canceled or rescheduled with less than 24 hours’ notice are non-refundable.

Missed appointments without notice are forfeited and are non-refundable.

A session becomes non-refundable once pre-session animal communication, preparation, research, or other service-related work has begun, except where a refund is required by applicable law or these Terms expressly provide otherwise.

If a client arrives late, the session may still end at the originally scheduled time. Heartwise may determine that a substantially delayed appointment must be rescheduled, and the appointment may be treated as a late cancellation or forfeited appointment.

Heartwise reserves the right to reschedule an appointment because of illness, emergency, technical difficulties, or circumstances outside Heartwise’s reasonable control. If Heartwise reschedules an appointment for one of these reasons, the client may choose either:

  • A rescheduled session at a mutually agreeable time; or

  • A full refund of the amount paid for the affected session.

10. Payments and Refunds

Payment is due in full at the time of booking unless otherwise stated.

All prices are stated in United States dollars (USD) and are exclusive of applicable sales, use, value-added, or other taxes unless expressly stated otherwise. The client is responsible for applicable taxes to the extent permitted by law.

Prices may change at any time. The price displayed and accepted at the time of booking will apply to that booking.

Once pre-session animal communication, preparation, or other service-related work has begun, the associated service is non-refundable, except where a refund is required by applicable law, or these Terms expressly provide otherwise.

Multi-session packages are discounted based on the client’s commitment to multiple sessions. Packages are non-transferable unless Heartwise approves a transfer in writing.

If a refund for unused package sessions is approved, completed sessions may be recalculated at the regular individual-session rate before the remaining balance is determined. Any approved refund will be limited to the remaining balance after that recalculation and any other lawful deductions.

Refunds will generally be issued to the original payment method. Processing times may depend on the payment processor or financial institution.

If you believe there is a billing error or service-related payment issue, please contact Heartwise at amanda@heartwiseanimalwellness.com before requesting a reversal from your bank or payment provider.

Before initiating a chargeback or payment dispute, the client agrees to give Heartwise a reasonable opportunity to investigate and resolve the issue. If a chargeback is initiated without first contacting Heartwise, Heartwise may dispute the chargeback and provide the payment provider with relevant documentation, including booking records, communications, intake records, session records, attendance information, and these Terms.

Nothing in this section limits a consumer’s rights under applicable law or a valid payment-provider dispute process.

11. Technology and Remote Communication

Remote services may use video conferencing, telephone, email, scheduling platforms, payment processors, cloud storage, messaging services, or other third-party technologies.

Heartwise is not responsible for outages, interruptions, data loss, connection issues, platform changes, or other technical problems caused by third-party providers or the client’s equipment, software, internet connection, or failure to access a required platform.

Clients are responsible for maintaining suitable technology and providing accurate contact information.

When appropriate, a session significantly affected by technical issues may be rescheduled. The resolution will be determined based on the circumstances, the extent of the interruption, and any rights required by applicable law.

12. Intellectual Property

All original website content, written materials, educational resources, session materials, graphics, branding, logos, and other original content created by Heartwise are protected by applicable intellectual property laws.

Clients may retain their personal session notes for private, non-commercial use.

Except as permitted by law or with written permission from Heartwise, materials may not be:

  • Reproduced;

  • Republished;

  • Distributed;

  • Sold;

  • Publicly displayed;

  • Modified for commercial use; or

  • Presented as another person’s work.

The Heartwise Animal Wellness name, logo, branding, and original materials may not be used in a manner that implies endorsement, affiliation, sponsorship, or partnership without prior written authorization.

Emotion Code® and Body Code® are proprietary systems and trademarks of their respective owner or owners. Heartwise does not claim ownership of those trademarks.

13. Website Information

Information provided on heartwiseanimalwellness.com is for general educational and informational purposes.

Although reasonable efforts are made to maintain accurate and current information, Heartwise does not guarantee that website content will always be complete, current, accurate, or error-free.

Website information should not be relied upon as veterinary, medical, behavioral, legal, or other professional advice.

Heartwise may update, remove, or change website content at any time without notice.

14. Third-Party Websites and Services

The Heartwise website may link to third-party websites or use third-party services, including scheduling platforms, video-conferencing services, payment processors, email providers, analytics providers, and other technology providers.

Heartwise is not responsible for the content, security, privacy practices, availability, policies, terms, or performance of third-party services.

Use of third-party platforms may be governed by the third party’s own terms of service and privacy policy. Clients are responsible for reviewing those terms and policies before using the applicable platform.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Heartwise Animal Wellness, LLC, Amanda Bate, and their respective contractors, service providers, agents, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to:

  • Use of the website;

  • Participation in Heartwise services;

  • Reliance on information received during a session;

  • An animal’s health, behavior, safety, or wellbeing;

  • A client’s decisions or actions; or

  • Any interruption, failure, or delay involving third-party technology.

To the fullest extent permitted by applicable law, the aggregate total liability of Heartwise Animal Wellness, LLC and Amanda Bate arising out of or relating to a particular service, booking, transaction, or claim will not exceed the total amount the client paid to Heartwise for the service giving rise to the claim.

Clients remain responsible for decisions regarding veterinary treatment, behavioral care, training, medication, nutrition, safety, and the overall care of their animals.

Nothing in these Terms is intended to limit or exclude liability that cannot legally be limited or excluded, including liability that applicable law does not permit a business to disclaim or limit.

16. Right to Decline or Discontinue Services

Heartwise reserves the right to decline, discontinue, cancel, or terminate services when appropriate.

This may include circumstances involving:

  • Safety concerns;

  • Harassment or abusive conduct;

  • Discriminatory, threatening, or unlawful conduct;

  • Requests outside the scope of Heartwise’s services;

  • Situations requiring urgent veterinary or emergency intervention;

  • Requests involving inappropriate or unethical treatment of an animal;

  • Failure to provide required information;

  • Nonpayment or payment reversal;

  • Repeated missed appointments or late cancellations; or

  • Circumstances in which continuing the professional relationship is no longer appropriate.

When appropriate, clients may be encouraged to seek support from another qualified professional.

If Heartwise discontinues a prepaid service or package for reasons unrelated to the client’s breach of these Terms, Heartwise will refund the amount paid for unused prepaid sessions. For packages, completed sessions may first be recalculated at the regular individual-session rate as described in Section 10.

If Heartwise terminates services because the client breaches these Terms, abusive or unsafe conduct, nonpayment, a payment dispute, or another cause attributable to the client, unused sessions will not be refunded to the extent permitted by law.

Termination does not affect provisions that by their nature should continue, including provisions concerning intellectual property, confidentiality, disclaimers, limitation of liability, governing law, dispute resolution, and payment obligations.

17. Privacy

Personal information submitted through the Heartwise website, intake forms, scheduling system, payment system, or communications will be handled in accordance with the Heartwise Animal Wellness Privacy Policy.

Clients are encouraged to review the Privacy Policy for information regarding the collection, use, storage, retention, and sharing of personal information.

18. Changes to These Terms

Heartwise may update these Terms & Conditions from time to time.

Changes become effective when the revised Terms are posted to the website, unless a later effective date is stated.

The “Last Updated” date at the top of this page will reflect the most recent revision.

Continued use of the website or services after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

For a booking or purchase already completed before revised Terms are posted, the version of the Terms accepted at the time of booking will generally apply to that transaction, unless the parties agree otherwise or applicable law requires a different result.

By booking or purchasing a Heartwise Animal Wellness service, you acknowledge that you have had an opportunity to read, understand, and agree to these Terms & Conditions.

20. No Professional or Veterinarian-Client-Patient Relationship

Booking or participating in a Heartwise session does not create:

  • A veterinarian-client-patient relationship;

  • An attorney-client relationship of any kind;

  • A licensed professional relationship;

  • A medical, veterinary, behavioral, training, or therapeutic relationship; or

  • Any other professional relationship that requires a license or credential Heartwise does not hold.

Heartwise does not practice veterinary medicine and is not a veterinary clinic, veterinary hospital, emergency service, licensed veterinary behavior practice, or animal-training provider.

Heartwise services do not establish a veterinarian-client-patient relationship or authorize Heartwise to diagnose, treat, prescribe, manage, or make medical decisions concerning an animal.

21. Assumption of Risk

By booking or participating in a Heartwise service, the client knowingly and voluntarily assumes the risks inherent in participating in intuitive animal communication and complementary energy wellness services.

These risks may include, without limitation:

  • Receiving information that is unexpected, uncertain, incomplete, or difficult to interpret;

  • Receiving no specific information or message;

  • Experiencing emotional discomfort when discussing an animal’s behavior, wellbeing, relationships, or life circumstances;

  • Making decisions based on personal interpretations of intuitive information; and

  • Experiencing no change or an outcome different from the client’s expectations.

The client confirms that decisions about the animal’s care, safety, health, treatment, behavior, and wellbeing remain solely the client’s responsibility and should be made with appropriate professional guidance when necessary.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Heartwise website, services, information, session materials, and session notes are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by law, Heartwise disclaims all warranties, including implied warranties of:

  • Merchantability;

  • Fitness for a particular purpose;

  • Non-infringement;

  • Accuracy;

  • Reliability;

  • Availability;

  • Security;

  • Completeness; and

  • Suitability for the client’s or animal’s particular circumstances.

Heartwise does not warrant that:

  • The website or services will be uninterrupted, timely, secure, or error-free;

  • Information received during a session will be accurate, complete, or independently verifiable;

  • The website will be free of viruses or other harmful components;

  • Any particular result will occur; or

  • Services will meet the client’s expectations or produce a particular health, emotional, energetic, behavioral, or other outcome.

Nothing in this section excludes any warranty or right that cannot legally be excluded or limited.

23. Confidentiality

Heartwise will keep client and animal information confidential and will not disclose it except:

  • As reasonably necessary to provide, schedule, administer, or document services;

  • To payment processors, scheduling providers, technology providers, or other service providers assisting Heartwise, subject to appropriate confidentiality obligations;

  • With the client’s consent;

  • To protect the safety of a person or animal;

  • To address suspected fraud, unlawful conduct, abuse, threats, or other safety concerns; or

  • As required or permitted by applicable law, legal process, or a government authority.

Client and animal information may include intake information, photographs, communications, payment information, session information, and follow-up notes.

Heartwise will use reasonable measures to protect confidential information but cannot guarantee absolute security for information transmitted electronically or stored by third-party providers.

Intuitive information, session impressions, and energy wellness observations are not medical documentation, veterinary records, or professional behavioral evaluations.

This confidentiality section does not prevent Heartwise from using information that has been de-identified or aggregated so that the client and animal cannot reasonably be identified, provided the information is not used to reveal confidential session details.

24. Testimonials, Client Stories, and Recording

Heartwise will not use a client’s name, testimonial, client story, photograph, animal photograph, session details, messages, or other identifying information in marketing or promotional materials without the client’s prior consent.

Consent may be requested separately and may be withdrawn for future use by contacting Heartwise in writing. Withdrawal will not require removal of materials already printed or distributed before the withdrawal was received, unless required by applicable law.

Clients may not record, photograph, screenshot, reproduce, livestream, or distribute a Heartwise consultation or session materials without Heartwise’s prior written consent.

Heartwise may make an audio or video recording only with the client’s prior consent and for a stated purpose. Any recording will be handled in accordance with the Privacy Policy and applicable law.

25. Governing Law and Exclusive Venue

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the website, or Heartwise services will be governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

To the fullest extent permitted by law, the state courts and federal courts located in Oakland County, Michigan (the county of Heartwise Animal Wellness, LLC’s principal place of business) will have exclusive venue and jurisdiction for any dispute, claim, or controversy arising out of or relating to these Terms, the website, or Heartwise services.

The client consents to personal jurisdiction and exclusive venue in those courts and agrees not to bring such a dispute in another venue, except where applicable law gives the client a non-waivable right to proceed elsewhere.

Nothing in this section limits any consumer protection, statutory right, or remedy that cannot legally be waived or restricted.

26. Severability

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified only as much as necessary to make it enforceable.

The remaining provisions will continue in full force and effect.

27. Entire Agreement

These Terms, together with any applicable booking confirmation, package terms, written service description, and the Privacy Policy, constitute the entire agreement between the client and Heartwise regarding the subject matter of these Terms.

These Terms replace all prior or contemporaneous communications, understandings, representations, or agreements concerning that subject matter, except for any written agreement expressly incorporated into the booking or accepted by Heartwise.

28. Waiver

A failure or delay by Heartwise in enforcing any provision of these Terms will not constitute a waiver of that provision or of Heartwise’s right to enforce it later.

A waiver is effective only if made in writing by an authorized representative of Heartwise.

A waiver of one breach does not constitute a waiver of any other breach or of the same provision in the future.

29. Assignment

The client may not assign, transfer, delegate, or otherwise dispose of any rights or obligations under these Terms without Heartwise’s prior written consent.

Heartwise may assign or transfer these Terms, in whole or in part, without the client’s consent in connection with a merger, reorganization, financing, sale, transfer, or other disposition of all or part of the business or its assets, or to an affiliated entity or successor.

Any prohibited assignment is void.

30. Force Majeure

Heartwise will not be liable for any delay, interruption, failure to perform, or inability to provide services caused by circumstances beyond its reasonable control.

These circumstances may include:

  • Illness or injury;

  • Emergency;

  • Death;

  • Natural disaster;

  • Severe weather;

  • Fire;

  • Flood;

  • Power or internet outage;

  • Technology or telecommunications failure;

  • Labor dispute;

  • Government order or restriction;

  • Public health emergency;

  • War, terrorism, civil unrest, or other security event;

  • Third-party platform failure; or

  • Any other event that could not reasonably have been prevented or overcome.

When reasonably possible, Heartwise will notify affected clients and offer a rescheduled session or another remedy required by applicable law.

31. Headings

Section headings are included for convenience and organization only.

Headings do not limit, expand, or otherwise affect the meaning, interpretation, or scope of any provision of these Terms.
